What is a tax audit?

There is a well-known Latin saying: “Praemonitus, praemunitus” – forewarned is forearmed. The same principle applies to tax audits. If you are prepared, you are already one step ahead.

It is difficult to find a business that has never been subject to a tax audit. Proper preparation helps you complete the audit with minimal financial and legal risks. In Azerbaijan, both individuals and legal entities may be subject to two types of tax audits: desk tax audits and field tax audits.

A desk tax audit is conducted by inspectors of the State Tax Service without visiting the taxpayer’s premises. The audit is based on submitted tax returns, payment records, and other available information.

When is a field tax audit conducted?

Field tax audits are divided into scheduled and unscheduled audits. They are carried out at the taxpayer’s premises based on a decision of the State Tax Service. The audit procedure is regulated by Article 38 of the Tax Code of the Republic of Azerbaijan.

In addition, an electronic audit may be conducted to examine the company’s digital accounting records.

The reasons for initiating an audit and the audit procedures are regulated by Resolution No. 1617050000011400 of the Cabinet of Ministers of the Republic of Azerbaijan dated 7 September 2016.

During a field tax audit, inspectors may review:

  • tax liabilities;
  • tax calculation and payment procedures;
  • possible cases of tax evasion;
  • compliance with the Tax Code for different types of taxes.
