Legal meaning of a residence permit

Under Azerbaijani legislation, the right of foreign citizens to live in the country is regulated through temporary and permanent residence permits.

A temporary residence permit is generally issued for 1 year and, where there are sufficient grounds, may be extended each time for a period of up to 2 years.

For foreigners or stateless persons who invest at least 500,000 AZN in the Azerbaijani economy, the permit may be issued for a period of up to 3 years and may be extended for up to 3 years at a time where there are sufficient grounds.

A permanent residence permit is intended for people who plan to live in Azerbaijan on a long-term basis. It is initially valid for 5 years. If the foreign citizen or stateless person applies at least 3 months before the expiry date, the permit may be extended for another 5 years.

Who can apply for a residence permit?

According to the Migration Code of the Republic of Azerbaijan, the following persons may apply for a temporary or permanent residence permit:

  • foreigners married to Azerbaijani citizens;
  • people engaged in employment in the country;
  • students studying in Azerbaijan;
  • people who have invested in Azerbaijan or own real estate;
  • specialists who have arrived for scientific, cultural, or humanitarian purposes;
  • other foreigners who meet the requirements established by international agreements and local legislation.

Process for obtaining a temporary residence permit

1. Preparing the application and documents

An application must be submitted to the State Migration Service (SMS). The application may be submitted electronically or directly at the relevant service points.

Depending on the basis of the application, the following documents may be required:

  • application form;
  • notarized copy of the foreign citizen’s passport;
  • document confirming registration at the place of residence, such as a rental agreement or ownership document;
  • medical certificate confirming the absence of specified infectious diseases;
  • employment contract, admission letter from an educational institution, or document confirming family relationship, depending on the grounds for residence;
  • document confirming payment of the state fee.

2. Review of the application

After the documents are submitted, the State Migration Service reviews the application for a temporary residence permit within 10 business days.

For highly qualified migrants, their children under the age of 23, and other family members, the review period may be 5 business days.

3. Receiving the residence permit card

If the documents are complete and comply with legal requirements, the foreign citizen is issued a temporary residence permit card.

The amount of the state fee for issuing or extending the card depends on the processing time and validity period. The relevant rates are set out in Article 14 of the Law of the Republic of Azerbaijan “On State Duty”.

According to Article 45 of the Migration Code, which regulates temporary residence permits, and Article 52, which regulates permanent residence permits, relevant categories may include:

  • the head of a legal entity established in Azerbaijan where at least one founder is a foreign individual or legal entity;
  • persons engaged in entrepreneurial activity in Azerbaijan;
  • other persons specified in the relevant provisions.

  • registration that meets the applicable capital requirements;
  • submission of relevant legal and financial documents.

Obtaining a residence permit based on real estate
